commitment.

General education for the property conversation. Your attorney should review the facts and documents in your situation.

Does divorce mean the home must be sold?

Do not assume a sale is required. The property decision depends on the facts, any agreement and court orders. Discuss the available choices with your attorney; Ryan can help clarify what a possible sale would involve.

Are sale proceeds always divided equally?

New York uses equitable distribution, which does not always mean equal division. Your attorney should evaluate marital and separate property issues and the applicable agreement or order. A sale estimate does not determine either person’s legal share.

Can we sell while the divorce is pending?

Have your attorneys review the automatic orders and any case-specific restrictions before making commitments. New York’s automatic orders restrict property transfers, subject to written consent, court orders and specified exceptions. Counsel should confirm the requirements for your proposed transaction.

Does changing the deed remove someone from the mortgage?

No. A change in title does not itself release a borrower from the loan. A divorce decree also does not automatically end responsibility to the creditor. Ask the servicer and your attorney what release, refinance or other approved arrangement is possible.

Is a market analysis enough for a buyout?

Ryan can discuss market positioning and relevant sales. Ask your attorney what valuation method and valuation date are required, and whether an independent appraisal is needed. A marketing estimate is not automatically the agreed or court-accepted buyout value.

Can Ryan handle the divorce negotiations?

Ryan’s role is real estate: property preparation, pricing, marketing and transaction coordination under an agreed scope. Your attorneys handle legal rights, settlement terms, disputes and proceeds allocation. Representation and communication arrangements should be established before services begin.
